ShareChat Terms of Use for Features

These Terms of Use (“Purchaser Terms”) govern your access to certain features in exchange for payment of prescribed fees (each a “Feature”) on the ShareChat mobile application and its versions (“App”), collectively referred to as the “Platform” made available by Mohalla Tech Private Limited (“MTPL”, “Company”, “we”, “us” and “our”. The terms “you” and “your” refer to the purchaser/ user of the Feature.

Your purchase and use of the Feature and any corresponding transactions are to be read with the Platform’s Terms of Use, Privacy Policy, Feature FAQs (defined below), ShareChat Payment Terms and the Content and Community Guidelines (collectively, “Terms”). The capitalized words used in these guidelines shall have the meaning given to such words in the Terms. In the event of a conflict between the provisions of the Purchaser Terms and those of the Terms, the provisions of these Purchaser Terms shall prevail solely with respect to your use of a Feature.

1. Features

We may provide various features from time to time. These Features may allow you access to experiences or special services from the Platform or tools and services to carry out commercial activities. Your use of the Features, and all information and materials published by you through the Features are your sole responsibility. The Platform acts as an intermediary and shall not be liable in any manner whatsoever. The details of each Feature are described in Annexure A (“Feature FAQs”). We may, at our discretion, change any aspects of the Features or stop providing the Features permanently or temporarily to you or to users generally with or without notice. We reserve the right to refuse Features transactions or to cancel or discontinue the sale or use of a Feature in our sole discretion. We will not be liable to you or to any third party for any such change, suspension or termination of Features. Prices for the Features are also subject to change at our discretion from time to time. We make no guarantee as to the nature, quality, or value of a Feature or the availability or supply thereof.

2. Acceptance

If you are accepting these Purchaser Terms and using a single Feature or a combination of Features on behalf of a legal entity, you represent and warrant that you have the authority to bind such entity to these ShareChat Purchaser Terms of Service, in which case the words “you” and “your” as used in these Purchaser Terms shall refer to such entity.

3. Changes to Purchaser Terms:

Please note that we may change these Purchaser Terms from time to time and we reserve the right to do so. The latest updated version is always available here and will govern your use of Features and any corresponding transactions. We will notify you from time to time of any material changes made to these Purchaser Terms. Your continued use of the Features after the revisions become effective constitutes your acceptance of the updated Purchaser Terms.

4. Termination or suspension:

If we believe that you have failed to comply with the Terms or Purchaser Terms, we may cancel your right to use any of the Feature(s). We may also take any enforcement action against you pursuant to the Terms or Purchaser Terms. You may also not be eligible for a refund for any amounts you have paid (or pre-paid) for Features.

We may suspend or terminate your access to the Feature(s) or parts thereof at any time at our sole discretion, including for violation of the Terms or Purchaser Terms, on order from a court of competent jurisdiction or governmental authority, or prolonged inactivity of your account on the Platform.

5. Features Are Non-Transferable between ShareChat Accounts:

Each purchase of a Feature applies to a single ShareChat account. If you have or control multiple accounts and you want access to Features on each account, you must purchase the Feature on each account individually. You may not allow others to use your ShareChat account to access any Feature that such person did not order.

6. Representations and Warranties:

You represent and warrant that you will use the Features only for lawful purposes in accordance with the Terms and Purchaser Terms, and that your access or use of the Features complies with all applicable laws, rules, and regulations. You further represent and warrant that you have obtained all rights, licenses, consents, permissions, power and/or authority necessary to grant the rights herein for any contents that you submit, post, or display on or through the Feature.

7. Disclaimers:

THE USE OF FEATURE(S) IS AT YOUR OWN RISK. YOU UNDERSTAND AND AGREE THAT THE FEATURES ARE PROVIDED TO YOU ON AN “AS IS WHERE IS” BASIS. WE DISCLAIM ALL WARRANTIES, CONDITIONS AND REPRESENTATIONS, WHETHER EXPRESS OR IMPLIED, OF (I) MERCHANTABILITY; (II) FITNESS FOR A PARTICULAR PURPOSE; (III) NON-INFRINGEMENT; (IV) THE COMPLETENESS, ACCURACY, AVAILABILITY, TIMELINESS, SECURITY OR RELIABILITY OF THE FEATURES; AND (V) WHETHER THE FEATURES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. YOU ARE RESPONSIBLE FOR YOUR USE OF THE FEATURES, AND ANY CONTENT YOU PROVIDE THROUGH THE FEATURES. UNLESS OTHERWISE EXPLICITLY PROVIDED BY US IN WRITING FOR A FEATURE, AND FOR THOSE FEATURES THAT YOU PURCHASED THAT ARE SOLD BY THIRD PARTIES, WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO ANY FEATURES PROVIDED THROUGH OUR APP.

8. Limitation Of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MTPL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE FEATURES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY POSTED THROUGH THE FEATURES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (III) ANY CONTENT OBTAINED FROM THE FEATURES; OR (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF MTPL EXCEED THE THE AMOUNT YOU PAID MTPL, IF ANY, IN THE PAST THREE MONTHS FOR THE FEATURES GIVING RISE TO THE CLAIM.

9. Governing Law and Dispute Resolution:

Any disputes under these Purchaser Terms shall be resolved in the manner provided in the Terms.

10. Force Majeure:

Neither Party shall have any liability for any interruption or delay in using the Feature(s) due to a Force Majeure Event. For the purposes of this clause, “Force Majeure Event” means any event or circumstance or combination of events and circumstances which is reasonably beyond the control of the party affected thereby and which causes or results in default or delay in performance by such affected party of any of its obligations under this agreement and includes fire, flood, accident, earthquakes, telecommunications line failures, electrical outages, network failures or an act of God.

11. Grievance Redressal

In the event that you have any grievances with respect to the Features, please reach out to us in the manner provided in the Terms.

These Terms of Use (“ShareChat Payment Terms”) govern your access to Features (as defined in the Purchaser Terms) on our mobile application and its versions (“App”), collectively referred to as the “Platform” made available by Mohalla Tech Private Limited (“MTPL”, “Company”, “we”, “us” and “our”), a private company established under the laws of India having its registered office at North Tower Smartworks ,Vaishnavi Tech Park, Survey No 16/1 & No 17/2 Ambalipura Village, Varthur Hobli, Bengaluru Urban, Karnataka – 560103. The terms “you” and “your” refer to the user of the Platform.

Your use of the Features and any corresponding transactions are to be read with the App’s Terms of Use, Privacy Policy, Features FAQs, Purchaser Terms and the Content and Community Guidelines (collectively, “Terms”). The capitalized words used in these guidelines shall have the meaning given to such words in the Terms. In the event of a conflict between the provisions of the ShareChat Payment Terms and those of the Terms, the provisions of these ShareChat Payment Terms shall prevail solely with respect to your use of a Feature.

1. Payment options

We offer various payment options that may vary by Feature, and we may offer additional payment options, or restrict the availability of certain payment options at our sole discretion from time to time. To the extent available, these payment options may include the ability to use the ‘in app payment’ functionality offered by Google or Apple, or to make a payment through our third-party payment processor.

2. Making payments

Please carefully consider the specifics of the transaction, as the overall price may include taxes, fees, and delivery expenses, including those required to be paid to either ShareChat or a third-party, for which you are responsible to pay. It is your responsibility to furnish accurate and truthful information about yourself and your business to comply with tax and regulatory requirements. All payments for Features are final and not refundable or exchangeable, except as required by applicable law. It is clarified that there shall be no refunds after delivery for any reason, including for accidental purchase, lack of requirement etc.

3. Services from third party payment service providers

As a user of the Features, you may need to also receive services from our payment gateway service providers, or any other online or mobile payment services provider that we may partner with. You may be subject to additional third-party Terms and Conditions, which are hereby incorporated by reference. Such terms may include terms from Apple or Google for purchases of Features made through their services. You are solely responsible for compliance with such third-party terms.

You may be required to provide the following information:

· UPI ID · credit/debit card details · bank details · transaction information: such as date, time and amount of the transaction payment.

This payment information is stored by our payment partners and is stored in accordance with applicable regulations (such as the RBI).

Our payment processors use this payment information to process and facilitate the payment towards the services.

We may be provided certain information in relation to your payments for our internal business and accounting purposes and for regulatory compliance.

Our payment providers may also use third party services, such as for fraud detection etc. and therefore may share the information provided. We will ensure that all such information is shared in accordance with applicable laws and keeping in place security measures as required by Indian laws.

4. Use of subscription-based Features

You can access certain Features as recurring subscription services:

Subscription plans are prepaid, non-refundable and automatically renew at the end of each subscription. You may get the discounts on subscriptions on the Platform as applicable for the first month. However, we will bill you from the second month of your subscription. You are free to cancel your subscription at any time following the cancellation procedures provided on the Platform or reaching out to us at grievance@sharechat.co .

There are no refunds or credits for any partial subscription periods, including in a situation where certain Features, benefits and/or services are modified or discontinued.

5. Cancellation of subscription

You can cancel your subscription to a Feature at any time. This can be accessed within your ShareChat settings once you have logged into the ShareChat Android/iOS App. If you purchased your subscription using our third party payment service provider, you may only cancel your subscription via such third party payment provider . You can also cancel your subscription by emailing us at grievance@sharechat.co .

Regardless of how your subscription was purchased, your subscription automatically renews unless you cancel at least 24 hours before your subscription period ends. If you cancel your subscription, your subscription will remain active from the time you cancel until the end of your current subscription period.

6. Actions we may take

We shall have the right to limit your ability to make a payment, revoke your eligibility to make payments through the App or deactivate your account at any time at our sole discretion. We may also cancel, suspend, reject or place a delay on any transaction for any reason, including without limitation if we suspect the transaction poses a business, financial or security risk, or is unauthorized, fraudulent, suspicious, unlawful, or violates these ShareChat Payments Terms or the Terms. In order to prevent financial loss to you or to us, we may contact your payment service provider, law enforcement or affected third parties (including other users) and share details of any payments that you are associated with, if we believe that doing so may prevent financial loss or a violation of law and/or our policies.

7. Disputes and reversals

We have no liability for any disputes with third parties in relation to a transaction on the App, including disputes over goods and services purchased on the App. If you order something from a third party through a transaction on the App, and the item becomes unavailable before it can be provided to you, you may request a refund of your payment from such third party.

In the event that you use the App to perform fraudulent activities, you may lose your funds with no recourse. You further agree to notify us if you believe that an unauthorized transaction has taken place through your account.

If you experience a technical failure or interruption of service that causes your payment to fail, you may request that your transaction be completed at a later time.

1. How does the ‘Jobs near you’ feature work?

You can discover all the Jobs posted in your city or nearby cities by different employers under the ‘Jobs’ tab on your home screen. Job posters and job seekers can connect directly with each other based on their location. This is a hyper-local feature to help Job seekers find nearby jobs. Please note that Mohalla Tech Private Limited is not responsible for any listings uploaded on the platform. Job posters are responsible for ensuring they upload accurate details in compliance with applicable laws, rules and regulations. Similarly Job seekers are responsible to check the details of the listing, review the profile, examine the job offerings and rely on their best judgment before making a decision.

2. What is a job listing? When I pay for a job listing, how long is the job listing visible?

A listing is a paid advertisement posted by the Job poster for available job opportunities under the ‘Jobs near you’ tab. There are three type of job listings which a job poster can post,District ad, Multi District Ad, State ad.

  • District ad : Advertisement visible approximately to users located in a district as chosen by the job poster.
  • Multi District ad : Advertisement visible approximately to users located in a district as chosen by the job poster and relevant nearby districts.
  • State Ad : Advertisement visible approximately to users located in a state by the job poster while creation. Location of a user - district wise is dependent on location services or self declaration? All paid job listings under the ‘Jobs near you tab’ will be live for a maximum period of 15 days. This is subject to compliance of the applicable terms. We reserve the right to remove your ads without any prior notice.

3. What are the eligibility requirements for a Job poster to post a listing under the ‘Jobs near you’ tab?

  • You must be 18 years or older in order to upload a listing
  • Your account should have a verified mobile number
  • You should either enable permission for location access or select your preferred location from the dropdown options under the ‘Jobs' feature

4. How can I post a listing under the 'Jobs near you' tab?

You can follow the below mentioned steps to upload a listing:

  • At the bottom right of your home screen page, click on the “Jobs’ button;
  • Click on the + icon on the top right.
  • Fill in the required details for the listing;
  • Submit the listing. Your listing will be sent for review and you will be able to see the status of your listing within 24 hours under “my ads” in the ‘my Jobs’ section. If your listing is approved, you will be able to see your post under the ‘my ads’ tab in “My jobs” section.

5. Can I upload a listing for any category of products or services?

You can only upload job related listings in the 'jobs near you' tab. Please note that the classified creator has to ensure compliance with applicable laws and regulations while creating and uploading the listings on the platform. Additionally, such individual is responsible for:

  • ensuring that the listing does not infringe the intellectual property rights of any person/entity/business or other third parties.
  • obtaining any such licenses, permits, consents, approvals and or other rights as may be required for uploading the listings or making any claims under such listings.
  • providing complete, correct and accurate details under the listings.

6. Do I need to choose my current location to upload a listing?

Yes, you can enable permission for location access or select your preferred location from the dropdown options under the 'near you' tab.

7. How can I verify my mobile number on the ShareChat platform?

You can verify your mobile number by selecting the three bar menu available on the top right corner of your profile. You can select the option to verify your mobile number. Once done, you will be able to see the 'mobile verified' mark.

8. What is the format for uploading a listing?

You can upload media with either one image or one video content with maximum duration up to 2 minutes.

9. What are the language options under which I can post my listing?

You may post your listing in the following language options as available currently: Hindi, Tamil, Telugu, Marathi and Kannada.

10. Where can I see my listings?

You can see your listings in the 'my listing' tab under your profile section.

11. How can I edit the status of my listing?

You can click on the three dot menu available on the listing for which you want to change the status and choose the edit post button in order to mark that listing as inactive.

12. Can I edit the details of my listing after it goes live?

At present, you can only edit the status of the listing. You cannot edit the details under the various fields of the listing once it is live. You may delete the post and create a new listing.

13. How can I delete a listing?

You can click on the three dot menu available on the listing and click on the delete option to delete the listing from your profile.

14. Can I share the listing with my friends?

Yes, you can click on the share button available at the bottom of the listing and send the listing by way of the options available under the share button.

15. Why isn't my listing live?

Your listing will be reviewed internally and may not be approved if it is not in compliance with our Community Guidelines or the posting guidelines such as; if the listing is not for a product or service under the listed categories, if the information stated in the mandatory fields of the listing is incomplete or incorrect and does not match with the category, if the listing is not in compliance with applicable rules/ regulations and our community standards or if the listing is under internal review based on third party reports or complaints.

You will be able to see the rejection reason of the specific listing under the 'my listing' screen. If your listing is rejected based on any of the above mentioned reasons, you may submit a new listing with the correct details and updated information. The new listing will be reviewed and the status of the listing will be visible under the 'my listing' section within 24 hours.

17. How do I know if my listing is visible to others?

You will be able to see various engagement metrics on your listing such as number of views, shares, likes and comments under the ‘my ads’ tab in the “My jobs” section.

18. Why has my listing been removed from the 'my listing' tab under the profile section?

You may not be able to view your listing if:

  • the listing is in violation of our community standards and other policies available here.
  • the listing is not in line with the listed categories or the details mentioned in the listing are untrue, incorrect and incomplete.
  • the listing has been deleted by the you.
  • the listing has been marked as sold.

19. How do I get in touch with potential classified users who are interested in my listing?

The classified users interested in your listing can reach out to you based on the contact information that you have agreed to share with the interested users. You may also contact the potential classified users who have shown an interest in your listing by clicking on the 'ad leads' option available under the three dot menu on your listing. Please note the information available for contacting the classified users is to be used solely for the purpose for which it is shared, in compliance with applicable laws.

20. Can I get a refund if the product/service in my listing has not been marked as inactive?

The payment made for uploading a listing on the ShareChat platform is non-refundable. Once the listing is approved and live on the platform, you cannot claim a refund.

21. Will I get a refund if my listing is rejected during the review process?

Yes, the paid amount will be refunded to your payment method within 5-7 working days, In case of any issue you can contact us at himanshugautam@sharechat.com

22. I am unable to access the 'jobs' tab and upload a listing. Why?

The 'jobs' feature is currently available only to select accounts on ShareChat. We are testing this product and closely listening to user feedback. We will be making further developments to the product before rolling it out to everyone. Please also note that a user who is restricted from uploading content on the platform due to violation of our community guidelines will not be able to upload a listing under the 'near you' tab for the restricted duration.

23. How can I view a listing under the 'near you' tab?

You can scroll and view the listings under the 'near you' feed. The listings will be shown based on the limited category/categories that are available under the 'near you' tab. You also have the option to enable permission for location access or select your preferred location from the dropdown options under the 'near you' tab in order to find listings based on your location. Please note that the listings will be shown to you based on your location.

24. How can I contact the classified creator of a listing I am interested in?

In order to contact the classified creator, your mobile number must be verified and your ShareChat profile must have a 'mobile verified' mark. Once that is done, you will be able to see the contact details of the classified creator who has posted the listing based on their permission to share such information. Please note the information available for contacting the classified creator is to be used solely for the purpose for which it is shared, in compliance with applicable laws.

25. What details should I check for, before I contact the classified creator of a listing?

We recommend you to thoroughly check the details of the listing, review the profile and inspect the product/service. Please note that the classified user is responsible for complying with applicable rules and regulations while making the purchase or availing the service under the listing. We have stated some tips below to help you. However, this is not an exhaustive list. Please rely on your best judgment.

a. Examine the details of the listing including the product's working condition, durability, invoice, purchase documents, certifications and registration conditions, price quoted, authenticity of the listing and other such parameters that may be essential before purchasing the product or availing the services.

b. Review the nature of services listed under the listing. Please make sure you thoroughly examine the product, business model or opportunity that is being promoted. The services promoted in the listing should be in line with our community standards and should not promote employment opportunities that are not in compliance with applicable laws e.g. offer multi-level marketing schemes, require adult services or use of adult products, involve illegal product and services, falsely represent an organization or a brand, are sexually suggestive in nature etc.

c. Beware of purchasing counterfeit products.

d. Beware of listings that solicit your personal information including financial information, OTP, verification codes, passwords etc.

e. Be wary of any unusual/doubtful behavior that may point towards fraudulent activities, spam listings, money making scams or listings that promote employment opportunities which may seem misleading and deceptive.

Mohalla Tech Private Limited is not responsible for any actions of the classified creator who has posted the listing or any claims made under such listings.
Please also note that Mohalla Tech Private Limited does not facilitate and is not responsible for any transactions/payments done between the classified creator and the classified user.

26. Can I pay in advance for the buying the product or availing the service under the listing ?

Please note that Mohalla Tech Private Limited does not facilitate the purchase or sale of listed items/services on the platform. We do not play any role in the transaction itself. Classified creators and users can arrange for payment and delivery between themselves. However, we recommend you to not pay in advance until and unless you have examined all the details of the listing.

27. Where should I meet the classified creator of a listing?

Please note Mohalla Tech Private Limited only connects interested classified creators and users by way of this feature. Please use your best judgment. If you're meeting in person, we recommend you to choose a safe public place to do so.

28. How do I report a listing or a user profile on the ShareChat platform?

You can click on the three dot menu available next to the listing/ user profile for which you want to submit the report. You can select the appropriate reason and click on the report option. You may also raise a complaint in-app via the help & support option available under profile settings or write to us at grievance@sharechat.co.

29. How do I buy bulk ads or bundle ads?

Bulk ads or bundle can't be bought in-App right now. Its under development. However, you can connect with the Sharechat team and let us know your requirements. Any bulk ad purchase will be only valid for 60 days from purchase. This means that once you purchase a bulk pack, all ads available should be created by the job poster within 60 days of purchase of the pack.

30. Will I get a refund if my listing is not visible in the targeted area as per the ad type or if I faced any technical error during the payment process?

This may be due to a technical error. You can contact us at classified@sharechat.com to resolve such issues.
